RCG Software Terms & Conditions

1. Eligibility

By using RCG Software, you confirm that:

-You are at least 18 years of age.

-You have the legal capacity and authority to enter into a binding contract.

-Your use of the Services complies with all applicable laws and regulations.

-If you are acting on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Changes to Terms

RCG Software may revise or update these Terms at any time. Updates will be posted on our website and are effective immediately upon posting. You are responsible for reviewing these Terms regularly. Continuing to use our Services after changes are posted signifies your agreement to the revised Terms.

3. Services Provided

RCG Software offers business automation, marketing solutions, and related tools to support entrepreneurs in managing and scaling their businesses. This may include but is not limited to:

-Marketing automation and CRM systems

-Lead generation tools

-Custom templates, workflows, and automations

-Educational content, training, and consulting services

We may modify, suspend, or discontinue any part of the Services at our discretion, with or without notice.

4. User Accounts

To access certain features, you may need to create an account. You agree to:

-Provide accurate and complete information during registration

-Maintain the confidentiality of your login credentials

-Notify us immediately if you suspect unauthorized access to your account

-You are fully responsible for any activity conducted under your account.

5. Payment and Subscription Terms

5.1 Pricing

Prices will be provided at checkout or specified during consultation. All fees are quoted in USD. Prices may (rarely) change and you will be notified in advance of such change.

You will receive a complimentary $10 credit on your account each month (from Maddy Roth) to use toward SMS/emails. Most clients report this covers their SMS and emails for the month. However, usage in excess of this amount will be charged in addition to your monthly subscription fee and is based on Go High Level's pricing in this guide. Pricing varies slightly based on usage and location (estimate for U.S.: $0.0083 per segment for texts, $0.014 per minute for making calls, $0.0085 for receiving calls, and $0.0007/email).

For example, for simplicity sake, say you use RCG software for email campaigns only, the $10 credit per month would cover 14,285 emails per month. If you go beyond this amount of emails, you would be billed $0.0007 per additional email beyond the 14,285.

5.2 Payment Methods

RCG Software accepts credit and debit card payments. By providing your payment details, you authorize us to charge your account for the agreed subscription or purchase fees.

5.3 Subscription Billing

Subscription plans renew automatically based on the terms selected during purchase. Unless canceled in accordance with our cancellation policy, you authorize RCG Software to charge your payment method on a recurring basis.

5.4 Refunds

All sales are final and non-refundable unless explicitly stated in our Refund Policy. No refunds will be provided for partial billing periods.

6. Acceptable Use

You agree to use the Services only for lawful purposes. You will not:

-Violate any applicable laws or third-party rights

-Attempt to disrupt, damage, or disable the Services

-Gain unauthorized access to our systems or data

-Use automated tools (e.g., bots, scraping software) without our permission

-Share or transfer your account credentials to others

-We reserve the right to suspend or terminate your account for violations of this section.

7. Intellectual Property

All materials, software, and resources made available through RCG Software are owned by or licensed to RCG Software. This includes but is not limited to content, designs, templates, graphics, and logos. You may not copy, reproduce, redistribute, or modify these materials without prior written consent. Unauthorized use of our intellectual property subjects you to a $10,000 USD fee per violation.

8. Termination

RCG Software may suspend or terminate your access to Services, with or without notice, if you breach these Terms, fail to make timely payments, or engage in fraudulent or harmful activity. Upon termination, any outstanding balances remain due.

If you choose to port your account or assets away from RCG Software, you agree to pay a $1,000 administrative fee, and all RCG Software–owned or affiliate-owned intellectual property will be removed from your account.

9. Disclaimers

RCG Software is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, or that results will meet your expectations. It is your responsibility to look through the pre-built emails, automations, or any content to ensure it does not contain errors.

10. Limitation of Liability

To the fullest extent allowed by law, RCG Software will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, even if we have been advised of the possibility of such damages. Our total liability will not exceed the amount paid by you in the previous 12 months for the Services.

11. Dispute Resolution

In the event of a dispute, you agree to attempt resolution through direct discussion with Madison Roth. If the issue remains unresolved, it will be subject to mediation or arbitration in the state of Michigan, United States.

12. Privacy

Your use of our Services is governed by our Privacy Policy, which details how we collect, use, and safeguard your personal information.

13. Governing Law

These Terms shall be governed and interpreted under the laws of the state of Michigan without regard to its conflict-of-law rules.
